Welcome to our Vibe Coding Platform (the "Service"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Description of Service

The Service provides a "vibe coding" interface that allows users to generate, iterate upon, and deploy software code using the Service’s API keys and computational resources. The Service acts as an intermediary between the user and various Large Language Models (LLMs).

2. Eligibility and Account

• You must be at least 18 years of age (and you must be above the minimum age of digital consent in your country) to use this Service.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information when creating an account.

3. AI Models and Usage Policies

The Service utilizes models from third-party providers. Your use of the Service is subject to the following additional terms:

• OpenAI: You must comply with OpenAI's Usage Policies.
• Google: You must comply with Google’s Generative AI Prohibited Use Policy.
• Meta: You must comply with the Llama Acceptable Use Policy.
• DeepSeek: You must comply with DeepSeek’s Terms of Use.

Any violation of these third-party policies constitutes a material breach of these Terms.

4. User Content and AI Output

Input: You retain all rights to the prompts, code snippets, or data you provide to the Service ("Input").

Output: To the extent permitted by law, you own the code and content generated by the Service in response to your Input ("Output"). The Service hereby assigns to you all its right, title, and interest in and to Output.

Similarity of Content: You acknowledge that due to the nature of machine learning, Output may not be unique across users and the Service may generate the same or similar output for other users.

License to Service: You grant us a worldwide, non-exclusive, royalty-free license to use, host, and transmit your Input and Output to provide, maintain, and improve our Service and to comply with applicable law.

5. Acceptable Use and Restrictions

You agree not to:

• Use the Service to generate malware, viruses, or any harmful code.
• Attempt to "jailbreak" or bypass the safety filters and system prompts of the underlying AI models.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service in a manner that exceeds reasonable usage patterns or constitutes "API scraping."
• Use the Service to infringe upon the intellectual property rights of others.

6. Disclaimer of Warranties

THE SERVICE AND ALL OUTPUT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

AI-generated code may contain bugs, security vulnerabilities, or errors. We do not guarantee the accuracy, completeness, or reliability of any Output. You are solely responsible for reviewing, testing, and validating any code generated by the Service before using it in a production environment or for any critical task.

By using this service, you agree that the code generated is provided "as is" without warranty of any kind.

You are responsible for the content you generate and ensure it complies with local laws and regulations.

We reserve the right to remove content that violates these terms or applicable law.

7. Limitation of Liability

To the maximum extent permitted by law, the Service and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service.
• Any bugs, security flaws, or errors in the AI-generated Output.
• Any unauthorized access to your Input or data.

8. No Professional Advice / Production Use Disclaimer

The Service generates code and technical suggestions using artificial intelligence. The Output is provided for informational and experimental purposes only and does not constitute professional software engineering, security, legal, or technical advice.

You are solely responsible for reviewing, testing, and validating any Output before deploying it in a production environment or using it in any critical system.

The Service makes no guarantees that AI-generated code will be secure, reliable, or suitable for any particular purpose. Use of any generated code in production systems, commercial products, or safety-critical environments is done entirely at your own risk.

9. Fees and Payments

If you use a paid tier of the Service, you agree to pay all fees associated with your plan. We reserve the right to change our pricing upon notice. Use of our API keys is subject to fair use limits; we reserve the right to throttle or terminate access for accounts that incur excessive costs or engage in abusive consumption patterns.

10. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties (including our AI model providers).

11. Indemnification

You agree to defend, indemnify, and hold harmless the Service, its owner, affiliates, and service providers from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to legal fees) arising from:

• Your use of the Service.
• Any applications, code, or content generated using the Service and subsequently deployed or distributed by you.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property rights or privacy rights.
• Your violation of any applicable law or regulation.

12. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service shall first be attempted to be resolved informally by contacting us at the email address provided below.

If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in the Province of Ontario, Canada, except where prohibited by applicable law. The arbitration shall be conducted in accordance with the applicable arbitration rules in Ontario.

Each party shall bear its own legal costs unless otherwise required by law or determined by the arbitrator.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data and your rights regarding your information. By using the Service, you consent to the data practices described in our Privacy Policy and the use of cookies for analytics and essential functionality as described in our cookie consent notice.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to its conflict of law principles.
